General Terms and Conditions

1. Basic Principles

These General Terms and Conditions (GTC) govern the legal relationship between the guest/customer/organizer, hereinafter referred to as the Guest, and Hotel Bahnhof (a general partnership) as the operator of Hotel Bahnhof, hereinafter referred to as the Hotel.


For the sake of simplicity, these GTC refer to the contract in general terms, regardless of the specific service.

 

Only the Hotel's terms and conditions valid at the time of contract conclusion apply. The Guest's general terms and conditions apply only if this has been expressly agreed to in writing prior to signing the contract.

Should individual provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the contract or the remaining provisions of these GTC. Otherwise, the statutory provisions shall apply.

2. Jurisdiction / Applicable Law

The place of jurisdiction for any disputes arising from this contract is Schüpfen (Canton of Bern), unless another mandatory place of jurisdiction exists by law.

Swiss law applies exclusively to all contractual, reservation, and any supplementary agreements and general terms and conditions. The place of performance and payment is the hotel's registered office.

3. Definitions

Groups: For the purposes of these General Terms and Conditions, groups are defined as travel groups with a minimum of 10 booked persons.

Written confirmations: Fax and email messages are also considered written confirmations.

Contracting parties: The guest and the hotel.

4. Subject matter of the contract / Scope of application

The contract for the rental of rooms, seminar rooms, and spaces, as well as the procurement of other goods and services, is concluded upon written confirmation by the guest or by implication.

A reservation made on the day of arrival is binding upon acceptance by the hotel.

Contract amendments become binding for the hotel only upon written confirmation. Unilateral changes or additions to the contract by the guest are invalid.

Subletting or re-letting the provided rooms, as well as their use for purposes other than accommodation, requires the hotel's prior written consent.

5. Scope of Services

The scope of services under this agreement is determined by the guest's individually made and confirmed reservation.

Unless otherwise agreed, the guest is not entitled to a specific room.

If, despite a confirmed reservation, no rooms are available at the hotel, the hotel must inform the guest promptly and offer equivalent accommodation in a nearby hotel of a comparable or higher category.

Any additional expenses incurred for the alternative accommodation will be borne by the hotel. If the guest rejects the alternative room, the hotel must promptly refund any payments already made by the guest (e.g., deposits). The guest has no further claims.

6. Period of Use

Unless otherwise agreed, the guest has the right to use the rented rooms from 2:00 p.m. on the agreed arrival day until 10:00 a.m. on the departure day.

For arrivals after 10:00 p.m., the hotel must be notified by the guest by telephone or in writing of the late arrival no later than 9:00 p.m. on the arrival day; otherwise, the hotel may freely dispose of the rooms.

If the guest vacates the room four hours or more late, the hotel may charge 100% of the full room rate (list price) for the extended use. This does not establish any contractual rights for the guest to continued use of the premises; the hotel reserves the right to claim damages.

In the event of late departure, the hotel reserves the right to remove the guest's belongings from the room and store them at a suitable location within the hotel at the guest's expense.

7. Options

Option dates are binding for both parties. If the option expires unused, the hotel may dispose of the reserved rooms/spaces or services without further notice.

Confirmation must be received by Hotel Bahnhof no later than the last day of the option period.

8. Prices / Payment Obligation

Prices quoted by the hotel are in Swiss francs (CHF) and include statutory VAT, any applicable tourist tax, and other charges.

The guest is obligated to pay the agreed-upon or applicable hotel prices for the room and any additional services used. This also applies to orders placed by companions and visitors.

Any increase in statutory charges after the conclusion of the contract will be borne by the guest. Prices quoted in foreign currencies are indicative and will be adjusted accordingly.
